Fitzgerald & Campbell, APLC successfully defended their client this past Monday against a civil complaint brought forward by American Express. Plaintiff had filed a lawsuit seeking nearly $40,000.00.
Trial commenced on August 10, 2018 in the North County Division of San Diego where Michael & Associates, appearing on behalf of Plaintiff, called two witnesses. William J. Campbell, Esq., Partner at Fitzgerald & Campbell, APLC attended trial on client’s behalf.
“We were able to adequately cross-examine the witnesses, and after Plaintiff finished their case in chief, we brought a non-suit motion arguing that Plaintiff had not established all the elements required,” says Mr. Campbell. “The court agreed and granted the non-suit motion, securing a verdict for our client.”
